stupid 18 yr. old hit my mach on the 1st real test drive!!!
Go to a decent doctor & make them do a lot of looking, X-rays, MRI... My wife had what was supposed to be a minor whiplash turn into a reoccuring nightmare! She got $9500, find out how much your state allows. I think I'd tell them as long as the neck injury doesn't stop me from entering the armed forces just to repair my car 100% with a complete strip & re-paint. You should chat with an attorney just to CYA.

Dude, go see a docter. I got hit in the wife's expedition from behind. I was at a stop on the down side of an overpass where there was much construction and a traffic light at the end of the overpass. Did no damage to the expedition. The other guys car was damaged. One of those toyota tercels. Late model but a piece of shi-t. Half primered and different color fenders. It wasn't his car. It was his girlfriends. He said that someone hit him from behind. Doesn't matter because it's your responsibility to keep a safe distance between you and the vehicle in front of you. The girlfriend did have insurance. We waited for a long time. The kid said he had to go to work out of town. And left. Finally when the police got there I explained what had happened and that there was no damage to the vehicle. So I didn't file a police report. Weeks later my back starts to hurt a little. I'm one of those dudes that avoids m.d.s like the plague. Fast forward a few months and it got to the point that it was hard for me to stand and walk after getting in an out of a car all day. Turns out that after the visit to the M.D., and MRI's I have ruptured, not hearniated disks. Should have remembered the rules. Rule number 1 Don't move the vehicle. Had I let the traffic back up Police would have been there much sooner. Rule number 2 Always get a police report. Rule number 3 Regardless of how small the incident may be go to the doctor. In my case I could probably still litigate. It has been less than a year. Could be difficult to win. Here's why. Waited a long time to go to the m.d. Don't remember when the accident actually happened. Did call 911 and probably obtain the date. Had a slight back problem about ten years ago. Nothing major pain for a week or so and then it went away. So maybe you couldn't say with absolute certainty that the accident caused this. I can say, however, that before the accident no problems, after the accident problems. The person that owned the car was not driving. The kid driving seemed like a bust out and a bum. I highly doubt that they have anything less than the bare minimum in insurance. Even if I did win. It's hard to collect from someone that has no money. Fortunately in my case I have some pretty good health insurance. You should have no problem getting the full 100% for your car. If they try to play games and give you 80%, you need to get a good lawyer and play the neck-injury game with them. A typical settlement with neck pain and a lawyer is around $5000.
Generally they will write you a check and say this is what we are willing to pay. If it isn't enough, DON'T CASH IT!!! because when you do, that is basically agreeing to their offer.
Good luck, and don't let them screw you over.

they are saying roughly 6-8k check coming if the cost comes roughly around the same as a newer car. maybe a lil more sinces its a fastback classic. so we might be looking at least 7k.
i honestly don't think it'll cost 7k to fix. i will go see a doctor for my neck. they better give at least 1000 dollars for a settlement because this might prevent me going into the airforce on time. ****, if it does, it better be like 30k.
i'm waiting until weneday for they're quote. then pick up that check. if i brought it to the body shop, they will look at it and say it isn't 6-8k damage worth and then they only pay what they have to. if it only comes to 4k then i pocket 2-4k. but again, i need to buy another radiator, electric fa, relay, and mechanical fan, possibly battery.
with this, they say its worth 6-8k and i just take it and cash it, then i'm not frauding because i had nothing to do with the estimate, i just excepted the money and ran.

stupid insurance company is now playing the 80% bull**** with me an i can't change his mind.
only thing i can do now is ask the body shop to estmiate 20% higher so its covered.

Call them & tell them this is your last request that they cover your loss. Any run around, let your insurance take over & get a lawyer tomorrow. You did nothing wrong & shouldn't pay to get your car nice again.

i'm going to talk with the insurance company again. they only want to pay for 80% of the rental car and doctor visits to.
i'm going to call up again. the company was going to pay 0% of his car and 100% mine. now its 20% his and 80% mine. this is stupid. he must have a stupid policy.

what can i do to not totally piss them off? i don't want to take it to the point where they will only now pay 50% and then i'm screwed even more.
the reported was totally his fault. he was in the wrong lane. so why is it partly my fault?
is a attorney the only way?

You need to give them a call and tell them that they need to pay the entire cost of full repair. If they say no, tell them that they will hear from your lawyer. Then, go find a sleazball lawyer who will drag them through the mud. If they won't meet your needs, you are just wasting your time talking to them. If you are happy with 80% then take it. Remember, they are just trying to minimize their pay-out. They don't have YOUR best interest in mind, they are just looking out for their bottom line. It's their job. Most people just take it in the rear.
If you do get a lawyer, get one that works on contingency, that way they will work harder to win.
