stupid 18 yr. old hit my mach on the 1st real test drive!!!

i finally got the mach sound legal with the header inserts and i drove her around the base and outside. it was just nearly time for work so i headed back. i drove into a parking lot going straight, this idiot decides to avoid traffic and cut into a parking. well him doing that he hit me making a wide turn going really fast. i tried to swerve out of the way and doing this i caused more damage to my car. he didn't hit the brakes and kept on going thats how he pushed me away.

he messed up both my fenders, hood, grill, bumper, valancer and etc. the police report is his citation causing the accident and my insurer said hes at fault. his insurer just called now and said he's mainly at fault. he said the worse case it'll be 80 percent covered. but he will come tomorrow and look at the car and tell me if they will pay 100 percent or 80 percent and a rental car.

this pisses me off when a 18 year old barely in the navy, barely getting his license and just getting his first car decided to be stupid and hit me when i worked endlessly for the last month and a half to get this car ready for my wedding date.

i should of not try to swerve and avoid him, i should of challenged that polyurathane bumper and smacked him in his door like i would of. i'm sure that car would of gone thru his door kill him, but at least my car's fenders would still be ok and maybe my hood.

Damn that sux I remember once someone hit my car in a parking lot when I wasnt around. They ran off and didnt tell me that sux. at least you got his insurance company.

1 thing dont take the first offer to fix your car from them go get several estimates and show them like the highest one. Hold out for the most.

Sorry to hear about that Xoxlie. That is just messed up!! The good thing, if there is a good side, the person was caught and had insurance etc. Plus nobody was hurt. Sure does irk a person though. I almost got me a little ricer doing the same thing here. They cut the corner into the parking lot as I was pulling up to the exit and urched the tires stopping to miss them. That was in the truck and the car still on the trailer! I called them a name and moved on. Probably didn't phase them any but i felt better. [img]/phpBB/images/smiles/icon_smile.gif[/img]

let me clearify my situation with this stupid new driver.

it was time for me to get back to work cuz the clock was going to hit noon. so i headed back and i made into a parking lot leading me back to work. on the right side of me was a line of big trucks and the other side of those trucks was 23rd ave on military base. there was alot of traffic because it was lunch time for everybody on base. knowing there is traffic and there is a big parking lot right next to it. this guy decided to turn right into this parking to avoid the traffic and intersection to go ahead and cut into the street he wanted to go into which was pacific. well he did that but going 30mph, hes making a right turn, therefore you should be closest to the right hand side curb. well he was so close to the left hand side curb. and this entrance is big enough where 7 or 8 cars to fit side by side and have plenty of space. thats just an idea how far he was away from his side of the curb. well this guy was on his cellphone. i was going 15mph and when my windshield past the last truck on the side which was next to the curb i saw him and i immeditely hit the brakes. this guy saw me and didn't even attempt to brake and kept on going, he wasn't even looking. i swerved to avoid the incident but he kept on going so he ran into my passenger side fender. the passenger side fender crumpled, tweeked my hood, forcing the other fender to tweek, crushed my grill shifted the bumper and valancer. damaged the bumper support, the 71-73 have a bracket and a small piece of the frame holding it and that shifted to the left.

this guy was going 30mph, made a illegal right turn into a parking lot going really wide, being on his cell phone, not attempting to brake. if this guy just turned closer to his curb this could been avoided. also, if he just attempted to brake as hard as i did, it would been avoided. if he was able to stop 5-6 feet from where he saw me i swerved and manuvered enough to just miss him, but now, he kept on going with his foot on the gas. it shows that i had tire marks attempting to brake and with him none.

he was cited for the cause of accident mainly because hes on the wrong side of the entrance to be making a turn and its illegal to cut thru a parking lot to avoid traffic (my bud would know that) he was going too fast, he was on his cell phone, and thats why he wasn't looking and never saw me.

my insurance company said i'm not at fault and so did the military police. his insurance company said at first that it sounds like he is, but still didn't speak to him. they called me back after speaking with me and he said they are just majorily at fault. i would think your at all fault or innocent. they told me in this kind of situation, they would pay roughly 80 percent of the damages and repair. but when i show him the scene tomorrow and the car, he'll determine if he'll pay 100 percent and a rental car or not. but he admits they are majorily at fault. he said the only reason why he's not 100 percent at fault is because when you go into a parking lot you have the right away. i said bull****!!!!!

hopefully i get the 100 percent and a rental car. i priced out all the parts that you can buy repo and it came out to be 1600 for only body parts. i am gonna tell them when they replace my radiator i want the alumium one made for my car, or they might just get the same one i had. after speaking with my dad, he says if they try to settle for only paying 80%, then we will go to court because they have to pay 100% and no money out of pocket.

also, the hood and fenders is basically 1/2 of the car. they said they won't pay for a whole new paint job even though its half the car. my dad said go ahead and let them do that but if it doesn't color match well, well they have to then do the whole car then.

thing is, most of the parts can be bought, but what about the parts that have to be found? polyurathane bumper, frame extension for the bumper, hood latch, headlight housing.

what the fook fook fook man!!! this was suppose to be my wedding driver. they better at least get me another mustang or a big truck.

i also have a sharp neck cramp in my neck. people are telling me to exaggerate my neck.

why in the f#%!e does this have to happpen on my first testdrive? she was driving so smooth, kind of boggish (small carb on a 460 and big cam) but very nice.

Sucks man, your car looked really nice! A few things to remember, YOU choose the shop to repair the car, not him or his insurance. Inform his agent of your neck problem immediately! A decent shop can match your paint. Get all the paperwork you can get from your paint job & let his agent know his settlememt will be unacceptable. Tell them a 30 year old car like yours is a classic & needs to be treated as such. The last thing is talk to a lawyer. Tell him you don't wanna sue, just cover your buns. Did this happen on base property? My '99 Wrangler was hit by a drug totin', no license holdin, red light runnin' idiot. I took it to a high-end shop & told them to fix everything & I needed the car. Gave them his company (Geico) & said call me. They wanted me to pat 20% of the repair. I told my agent & got a lawyer. Got my Jeep back in a week, cost me $00000000, noda, nuthing, zip. The police determine who is at fault not the insurance company so don't let them tell you otherwise.

the insurance companies are taking their opinoin on who's fault it is and it isn't changing from the police report. my insurance said it's not my fault, and his insurance company said they are at fault and he except 100% cost for everything. this idiot has some guy witness something and he ended up not even being on his side, he had nothing going for his story. the guy who was his witness told the insurance company he was on his cellphone and wasn't looking the entire time and thats why he never attempted to brake until he already drove thru me, because he never saw me due to his cellphone. the guy is denying his cellphone call and the insurance company is trying to ask him what company he has but he won't tell the truth if he has a cellphone. so they can't look up if he wasa on the phone during the accident.

the insurance company looked at the car and he said they are 100 percent fault and it was a good hit. from how the damage looks like, and for a estimate for a newish car, it'll be 6-8k to fix it. and i told them i worked endlessly for 2 months on this cara to get ready for my wedding, so i have alot of pain and suffering from this and now i don't have a car for my wedding besides my ranger which isn't a wedding type vehicle.

he said he could acomadate me a car but at 22, i can only get a full size car. and hes trying to settle with me on my neck. he tried to tell me if i'll settle for a 100 dollars. i wanted to laugh so hard. i said my injury isn't worth 100 dollars. and if this prevents me joining the military when i'm suppose to then i'm really gonna come after them.

i already picked out a body shop for the car which does 5-10k paint jobs. they only want to pay for 1/2 the car for the paint, so i asked the paint shop if we can work out a deal just to paint the whole car instead and just tell the insurance company they painted only 1/2.

how much do you think i should settle for on my injury? my parents want me to go to a doctor to make sure nothing is wrong and see them anyways because there might be something wrong later. if i am hurt somewhat, what can i claim for? it better be huge dollars if i can't go into the air force in march.
