Illegal Immigrant question

I have searched on the internet and not found an answer to this question so I decided to post it here. Without opening a huge can of worms I have a simple question to ask. I am not interested in delving into this topic beyond that necessary to get my question answered. If an illegal immigrant has a child by a US citizen, how does this impact his/her illegal status? Is there a website that contains this and other information related to this topic?

The way I understand it, an illegal giving birth to a child on American soil is automatically granted legal alien status. It doesn't matter whether the father/mother is a US citizen or not. I watched a segment on 60 Minutes or Dateline on this very subject a few years ago. Wish I could give you more details, but it's been awhile since I watched it.

So if an illegal male knocks up a US citizen does he automatically get legal status?

Illegal Immigrant question

A child born on American soil has legal citizenship no matter if the birth mother is a citizen or not.Say a Mexican woman crosses the border for the day and gives birth in the states the child is an American citizen.This happens on a daily bases.

My bad, I didn't make the question clear. If an illegal male knocks up a US citizen, does the illegal male get legal status? I know that the child gets legal status.

NO he does not. Having gone through all the legal BS involved with getting my wife legal[img]/phpBB/images/smiles/icon_rolleyes.gif[/img] Her learning visa expired, I can tell you it is not a fun process. Even getting married is not a Gaurantee anymore. If you need anything else answered just PM me.

1badmav is right, he does not get legal status. And on the topic of marriage not even guarenteeing status, your right there too. You have to petition a fiancee to bring them to the states, then get married, and then more fun begins! And if th fiancee was previously married, make sure the divorce is recognized by that countries consulate, it may not be acceptable, I learned this the hard way. My fiancee was "divorced" for many years according to Philippine doctrine, but the US consulate their doesn't recognize that way of it being done. We just went through a drawn out court time to get it legitimized so the consulate will recognize it. Now I get to start the fun part of petitioning her!! SHe is definately worth all the work we've gone through to get to this stage though!
