Ford Settles Manifold Lawsuit

Ford Intake ManifoldIf you own a 1996-2001 Ford, Lincoln, or Mercury vehicle, equipped with a 4.6L 2V engine, you may have received a letter last year from a law firm notifying you of a class action law suit. The suit was brought on by individuals who claimed their intake manifold failed, leaving them stuck with the expense of having to replace the faulty piece. In some cases the resulting coolant leakage into the engine caused major engine damage. The lawsuit claimed that Ford was aware the manifolds were prone to cracking and premature failure. We’re not sure why Ford decided to fight the suit, rather than settle out of court or better, simply offer up good customer service and recall or replace the defective manifolds. As was revealed in the court case, Ford certainly knew of the problem…
In 1999, Ford issued three ]Technical Service Bulletins( TSB’s 97M91, 99M01, 01M02) for the cracking problem.
In March 1999 A.R.O’Neill, Director of Vehicle Service and Programs, Ford Customer Service Division, issued an “Owner Notification Program” numbered as 97M91 (1 2) to “All Ford and Lincoln-Mercury Dealers”. This correspondence stated, in relevant part, the following:

While Ford has offered to replace these defective intake manifolds free of charge for cars purchased by police forces and taxi cab companies, they have yet to offer such a “recall” to individual consumers who purchased the same cars. Consequently, consumers must pay for their own repairs if the defective manifolds fail.

Even more discouraging was the discovery that Ford replaced, at no cost, the manifolds on taxi’s and police cars, presumably to remain in good standing with fleet purchases of those vehicles. Consumers however were not extended such warranty.

According to the Associate Press, Ford Motor Co. has finalized a settlement that requires the automaker to pay at least $735 US each to owner of a qualified make and model who had to replace an intake manifold. Ford also is extending warranty coverage on the plastic part to seven years to cover vehicle owners who haven’t replaced the manifold. The class-action lawsuit covered a total of 1.8 million vehicle owners, according to Morrow Cater, a spokeswoman for the plaintiffs.

“Until this settlement, those who owned or leased these cars had to bear the brunt of the manufacturer’s mistake,” Mike Ram, one of the plaintiffs lawyers, said in a statement.

“Although we believe the class action was without merit, we are pleased that we were able to negotiate a settlement that will provide additional value to our customers,” Vokes said.

Owners who replaced their intake manifolds within the first seven years of ownership can take the vehicles to a dealer and obtain reimbursement whether or not they have a receipt. The vehicle must be brought to a dealer by March 16.

  1. Oh yes. 2001 Mustang GT here. Cracked manifold here. No love from ford motor company here, either.

    Just because the “defective part” on my car outlasted the extended warranty by a year, I’m screwed. Two people with customer retention (which was more like customer debriefing…as they did NOTHING to retain me as a customer) told me that the judge ordered the warranty extension, and that by only honoring what the judge said, they were in turn honoring the settlement conditions and complying with their legal end of it.

    I’m writing a letter to ford even as I type this, but my expectations are low. for me, it would certainly take another class action deal, because we all know that retaining a lawyer and having him/her work on this for even just a WEEK, could easily triple the cost of fixing the damned thing straight off.

    That must be their ace. They can sleep in good conscious knowing that they’ll stay out of court (for the moment) I’ll eat the repair cost and then I’ll have to jump through the class action hoops to get my money back.

    like one poster earlier said; police and ambulance fleets were clients not worth losing. But the everyday you and me folks? Fat chance.

This is a bit different….but, I just bought a one owner 96 Cougar witha 4.6 engine & the car has been cared for pretty well by the previous owner, but just 2wweks after I got the car, it began to run warm & loose antifreeze. After inspecting it over, I found out that on teh back of the engine where the heater hose connect to the engine, there is a half inch crack running down the neck of where the hose attaches. I belive this is a piece that cannot be replaced without replacing the WHOLE manifold. Seems the material used in making these manifolds is junk. No water is leaking into the engine that I have noticed yet….but if I can’t find some way to SEAL this small crack up with some kinda glue or sealant….I’ll have to fork out many hundred bucks to fix a very “small” problem.

  5. I have a 1999 crown vic with a 4.6 litter eng. the car has 61000 miles on it,today I tookthe car to the garge to have the intake manifold is cracked and the cost to me is $1200, and Iknow I won’t get any money back from ford, todays date 6/18/09,I think ford should pay.


  6. I bought a 1998 Lincoln Town Car a few weeks ago and it is at the Ford Service now. They just called and told me that I need to have the intake manifild replaced and the cost to me will be $1500.00!


  7. i also have a cracked manifold. it has had a small leak for some time and i never new it was from the manifold until i took it in to have spark plugs changed.when ever i had the oil changed they just added coolant. do i have any recourse?


  8. I have a 1999 MGM that I purchased used in 2005, a year before the time limit ended, from the used Ford/Mercury dealership here in Bakersfield, CA. These vehicles are “supposedly” inspected and “ok certified”. If that’s the case, why was it not noticed that the part to be replaced at the front of the engine was plastic and not the aluminum replacement, which even as a woman I can see? Nor was I notified at time of purchase or in the year I have left of that particular recall? I learned of the crack in 2007, now I am faced with the expense of the repair. Any info on a new class action suit or where to start one would be helpful.


  9. I have a 1997 Mercury Grand Marquis w/ the 4.6L. the plastic manifold were the heater hose connects is craked and is estimateds to cost around $ 800.00 to repair. Is this part of the recall and will Ford pay any costs to repair this problem.


  10. I also have a 1999 Grand Marquis and the heater hose connection was smoking and i smelled antifreeze but never seen any on the floor. Now I am told its the crack intake manifold. I trook to two gas stations and told that it will cost $1,000. Wow in 2008 to pay $1,000 for a 1999 car is unbelievable and unfair when I read this is a plastic peice. I am a girl who barely knows about under the hood but common sense tells me that plastic is not a good idea for anything that is hot.
    I feel a second class action suit shoul start for any owner of these plastic manifolds. 2nd car owners should not have to pay for something that is known by the company not to work. No one should have settles on only a seven year limit. Or for ist time owners.
    This should be a recall peice for everyone they made!!!!

    How does a second class action suit get started for this?


  11. I presently own a 1999 Mercury Grand Marquis. I suddenly had problems with it miising, and hesitation. I replaced the plugs. Didn’t help. I then decided to change the rubber boots to the plugs, as they were deteriorating. When I got to the aft right plug, I noticed anti-freeze in the plug hole. Yes, I had a cracked manifold at the heater hose connection. It took over a week to notice this, I cleaned the fitting, and added red RTV in the fitting. Then I applied some epoxy to the maniflod outside of the threads. It seems to be holding, for now. The car is a 1999 and I am sure it is out of the seven year limit. So I will have to bite the bullet, and spend the cash to fix it. But, no more Fords for me. I hate to say, but I may go for a Honda, or Toyota the next purchase I make.


  12. I have a 2000 Ford Windstar…not one of the models listed as part of the lawsuit and settlement. In 2005 the manifold cracked. The repair shop mentioned to me that he had just recently replaced another Ford Windstar’s cracked manifold, as well as several cracked manifolds on other Ford and Mercury cars. The bill was over $1000. I contacted the Ford dealership and was told there was no recall on that part. I just recently read about the lawsuit in the paper, so I found this on the internet. My car had just over 90,000 miles on it at the time. Any chance that Ford will (a) extend the refund to include their other models with a similar problem and (b) extend the rebate time? This is really a ripoff!


  13. 1/21/08 - My 1998 Towncar was just diagnosed with this intake manifold problem. I am now in the process of replacing this defective manifold. I too would like to know where to send my receipts for reimberstment.


  14. I own a 96 Lincoln Town Car. You guessed it, the plastic manifold has cracked what a crock. How does a vehicle that cost $40,000 dollars, 10 years later and only 120,000 miles give way to such a major problem to the main part of the vehicle, the motor. I think the Ford company engineers knew that this problem would arise and let this design go forward. I am now stuck with paying $900.00 dollars to fix this problem and I won’t be guaranteed that this problem hasn’t already caused major damage to my motor that probably won’t arise until a few months down the road. This is poor business and that is probably why foreign vehicles are better vehicles because I searched the web looking for cracked manifolds on foreign vehicle and found none. Ford needs to get with the program. If you want to charge big money make sure your product is worth big money.


  15. My manifold went bad in Feb. of 2006, while my husband was in bad shape full of pnemonia. I had to replace it, I read on line about every car being recalled except for passanger cars, I have a 1996 Lincoln Town car, so I emailed Ford about this and said that if there was ever a class action lawsuit over this I was going to join in on it, because the day that the manifold cracked I was going to the hospital to pick him up, it was cold and he did take a back set on it and where he is a diabetic, it took about a year for him to get over it. They emailed me back on Feb. 28th. 2006 and wanted to know the mileage and vin # and about every thing else BUT NEVER ONCE TOLD ME ABOUT THE LAW SUIT. I just found out today about it, while searching the web on some other recalls. there are a lot of recalls on the 96 Lincolns that no one is ever aware of a lot of these recalls are the same ones that are wrong with my car. WHOSE SAFETY ARE THEY PUTTING FIRST.

  17. Just two weeks ago, my dad (who is on Social Security) had to pay almost $800.00 to have the plastic manifold replaced in his 1997 Lincoln Towncar. In addition, there was a tow charge, plus payment for a new thermostat
    ( which, of course, was not needed.) It is so sad that he had to pay this outrageous amount for something that should have been recalled years ago. Does anyone know of any way he might get some kind of reimbursment for this? Any suggestions will be greatly appreciated! Thanks so much.

I was notified about the lawsuit in 2005, never thought it would happen to me, but I just had my mechanic replace the intake manifold when a crack was found and the check engine light wouldn’t go off. I have spent over $600 to replace it. What I want to know is how do I get reimbursed? I have all my receipts. Thanks


  20. I bought my 1999 Ford Crown Vic Police intercepter in 4/06 from ebay. The car had 69 K miles and was a former Connecticut State Police Fleet Vehicle. It came with an extended waranty good till 12/06. I took the car to Syosset Ford in Syosset, NY on 5/4/06 to do ALL the warranty work including the passenger side head gasket that was leaking oil. The entire front end of my car was taken apart as was the engine. I specifically asked the dealer is there anything else that we should do as long as he is going to have my car for 2 weeks to complete the repair. We agreed to change the plugs and water pump too. Not once did the dealer mention anything about the intake manifold leak problem. On 5/14/06 my 7 years ran out for the manifold leak warranty. On 2/6/07 I noticed that My intake manifold was leaking so I went to the dealer that I just bought a fully loaded 2006 Ford Explorer Eddie Bauer from. His service guy gave me an attitude and basically told me I was shit out of luck. I asked him why didnt you do the repair when you knew there was a problem. He said that it wasn’t leaking then so he wouldn’t do the repair. Now you want to know why Toyota is blowing Ford and GM out of the water. America we are our own worst enemies. My 3 yr 36,000 extended warranty just exoired in 12/06. I owned fleets of fords before and now. I look abroad. I urge you all to do the same. As much as we here on these web sites try to hang on to our loyalty to this company it still beats us down. Look at all the Mustang enthusiasts. Now anything with the Mustang name in its business is under attack by the ford trademark infringement lawyers. Am I mistaken or was their Mustang name taken from the wild horses that roamed the american plains. Why don’t we all get together and sue ford for stealing the mustang name from the wild horses and then take the winnings and fund tha save the wild mustangs program. Join me in supporting Darrel Waltrip and his Toyota Camry racing team in a F U to the Ford and GM machines.

  21. IN November 2007 my manifold on my 1998 Marquis died along with the heads etc. WE went on line to find out about obtaining the parts. We were so surprised to find out that there was a problem and a class action law suit. We had never received any information from the attornies, or Ford. I had always taken my car to Ford to have even the oil changed. Not a word was ever told to us about the manifolds. So we called Ford and ask if they could just fix the car, customer service said no. What happened to my country? This is not the American way!!! The car companies always stood behind their products from the 50’s - 70’s and now the 21st century we have to have law suits so a few can have their cars fixed and the rest….
    In tonights news they are talking about the 12 billion that Ford has lost. What happened to customer service?
    What happened to Ford producing and standing behind their products for the benefit of all their clients? Didn’t they know to treat all people as clients not as customers. Once upon a time car dealers believed in repeat business. We use to have great cars and America had the best. In the 50’s there was pride iin the workmanship of the cars. What happened? Does any manufacture care? Most of the people running Ford are old enough to remember how great the cars were. Of course, that was before plastics. Before they took short cuts.


  22. This again proves to me how many real world situations lawyers are very stupid!! A defect is a defect. What about all the failures of this manifold after this date, mine included! People do not have time to sit around and keep track of recalls and defects of all the things that they own. The specifics of this lawsuit screwed a lot of people.


  23. i thought that the lawyers would of sent a letter telling us that there was a settlement just checking on this to day 6 7 06 finding out it to late that makes me sick plus i sold the car but i have the bill from repair


  24. I filed a claim for the manifold lawsuit on February 7th, 2006 at Tropical Ford in Orlando. I replaced my manifold in 2002, for around 900.00. I heard about the lawsuit and decided to look into it. I found out I did qualify for the refund. I had the car inspected and the service manager told me to expect a check in about 2 weeks. I did not receive any check, or any information regarding this matter from the dealer. I called yesterday (March 21, 2006) and talked to the service manager, he said I did not qualify because I did not have a receipt. But, according to the lawsuit settlement, it says you do not need a receipt, and a pre-determined amount of money will be paid to the owner of the listed Ford cars. My car was on the list, so, I did qualify. I will be taking this matter to an attorney for further advice.

    VARIOUS INQUIRIES, I RECEIVED THE FOLLOWING OFFER FROM THEM TO PARTICIPATE IN A SWEEPSTAKES AS FOLLOWS:


  28. In August 2002, the intake manifold in my 1996 Grand
    Marquis cracked, spilled coolant all over my engine, car
    overheated and destroyed the engine. I called Ford at
    that time and was told they had not had any problems with the intake manifold,and there was nothing they could do for me, since my mileage was past the extended warranty. Instead of junking the car, I opted to replace the intake manifold and install a different used engine, at
    a cost of three thousand dollars.

    When I learned of the class action suit, I wrote the attorneys handling the case, before becoming a class member, I was advised in writing that “covered costs include the cost to replace the intake manifold, as well as associated damage to the remainder of the vehicle that was attributable to a failure of the intake manifold and could not have been avoided by reasonable care of the Settlement Class Member.

    I filed my claim in December 2005 for $3055.00 and received a check from my dealer, Country Lincoln Mercury
    Sales Inc, Huntington, New York for $735.00, marked
    “warranty”, which I accepted “under protest”

    I called and then wrote to the dealer mentioned above,
    Bill Ford, CEO of Ford Motor Company, (letter written on February 8, 2006, via certiified mail, return receipt requested) Ford Customer Relations Dept., attorneys
    Levy, Ram and Olson LLP, who litigated the class action lawsuit, but as of today, I have not had an explanation why my entire claim, verified by copy of original invoice from mechanic who did the repairs, in the amount of $3055.51.

    I have written to Judge Claudia Wilken who approved the settlement order, and have filed a small claim lawsuit
    against Country Lincoln Mercury Sales Inc. for the balance due on my claim as outlined in my receipt and damages covered in the settlement order.

  30. Under the agreement, Ford will reimburse consumers with receipts for repairs related to the intake manifold. The Dearborn-based company will also pay $735 to anyone without receipts who verifies with a company dealership that the repair was made, the agreement said.


  31. I have a 1997 cougar that was built 13 days before the effective refund date. The intake manifold went today and the repair cost will be just over $1000. Am I just out of luck? The manifold was clearly defective. This just frosts me. I was thinking about buying a mustang, but I have reconciled. If anybody has an idea on how to get Ford to take responsibility please let me know.


  32. Well, I finally got my refund from Ford. I had to come up with a receit for my repairs in 2002 on my 97 mercury. I was told that I had to have a receit since my car was over 7 years old. After much searching thru canceled checks I finally came up with a check for manifold. I still believe I was due a refund without a receit since ford inspected my car and knew that the manifold had been replaced. I think Ford is makeing the process as difficult as possible to get out of paying these claims. When I took my receit to my local dealer. They issued me a check in about three weeks


  33. My 1997 crown vichad the manifold fail last week. Feb.21, 05. 69000 miles was told wasnt covered because it’s been over 7 years since it went into service. What a way to run a company.Screw the loyal buyers, I own 5 cars I will never buy another ford product and will discourage everyone i know not to buy. Why do you think ford stock is going to hell, not hard to figure out when they run a business like this.

    Did you ever got your refund? I submitted mine January 4, 2006 but I have not received anything yet. If anybody got a refund could you please tell me how many weeks it tooks.

  35. My father in law took his 96 Lincoln to the dealer today when he found out about the settlement. He was skeptical about getting anything but went anyway. At first the dealer told him that it had not been settled. When my f.i.l. told him that he knew it had been, the dealer made a call to someone and came back and told him that it had indeed been settled, but, unfortunately the car, even though a 96 model, was produced early in the run, in 95, so was not eligible.

My ‘96 G.T. is in a Ford dealership as we speak. the repair for my FOURTH intake manifold (counting the original) will cost me over $900.00….The manifold was replaced twice…Once under warrantee, the last time in 2002 as a goodwill gesture as Ford some times rewards good customers especially when they know it is a faulty part. I am getting the third itineration of the manifold, yet be paying for it out of my own poor pockets…………I have no problem with paying for it ,if only to get my beloved G.T. back on the road…All records are in the computer at the dealer so I will get them all tomorrow when I pick up my car. Is there really any way to be compensated for this repair? It’s only been 8000 miles since the last manifold was replaced (by the same dealer). Ford customer service was of zero help, which is too bad ,I was considering purchasing a Shelby G.T.500……I just might be done with Ford forever…..

  39. We have contacted the law firm that handled the class action Arthur Levy class@mail.lrolaw.com They were no help. They told me I was required to have a receit. It seams the lawyers have their money and they don’t care about the people they claim to repersent. Even the IRS don;t expect anyone to have receits past 3 years’

    You are cover since you replace the manifold within 7 years.
    Take the receipt to a Ford,Mercury or Lincoln dealer and you shall get a refund. But you must do it before March 16, 2006.

    If anybody received a refund please posted I file mine January 4, 2006 and I did not get a refund yet.


  41. I have the same problem. I have a 97 . I replaced the manifold in 2002. I was told my car was not covered, because It was past the seven years. The settlement says, The warranty only applies to manifolds that have not been replaced. I think someone needs to go back to court on this. I have always owned ford/ mercury products. After this experience I will consider a different Brand automobile.


  42. I would like to hear about anyone who actually gets reimbursed. It seems like the dealerships are giving alot of folks the run-around. Anyone know who to contact if a dealership gives you trouble?

  44. I had all my reciepts and they told me that I had to do it before the 7 years that it was bought I don’t understand that. It says that the years are from 96-02. My car is a 97 and I had the work done on 12/04. It seems to me like this car is still good for it. I took the car to a Ford dealer on Friday 20 and they called me on Tuesday the 24 to tell me it doesn’t cover my car.

  45. We submitted the bill for these repairs to the dealer where repairs were made. We were told we would probably receive a check in about 2 weeks. It will be a month on Jan.29th & we have not received anything. Do you know from where this money is paid. The dealer tore off the top of the Invoice he was submitting to wherever.


  46. Ford is playing games with me about the manifold. My intake did fail back in 2002 resulting in a big $800 repair bill. I lost my receipt, but I called my dealership where I bought my car and it was the same place the repairs to the manifold were done. I called the dealer and asked 1 question..DO you keep records of the cars you service here?..she replied, “yes”. She then took down my VIN and checked my history on her computer. She says, “yes, you were here back in 2002 for the repair.” Now under the notice, if you have the receipt or if you have a copy, or get a hold of a duplicate then the Dealer can submit for reimbursement from Ford Motor Co. I was thrilled, the dealer had a copy, I’m good! Not the case now, they gave me a million excuses that they cant find it now…Because of this, under the terms of the notice, The dealer may inspect the car, and see that the manifold has been replaced, you then sign the clause on the notice stating that under the penalty of pergury, “I replaced the manifold because it failed and paid out of pocket”. My dealership is giving me the run-around, they are trying to say I’m not entitled to the refund!!! Saying that the warranty was extended and it has expired. No way!! The extension apllies to owners who’s manifold hasnt failed yet. Regardless of anything, I signed under penalty that I’m good and deserve the refund!!! help!!
